1. Introduction and Acceptance

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Rest Easy Custom (“Company,” “we,” “us,” or “our”), a company operating the website www.resteasycustom.com, and any person (“User,” “you,” or “your”) who accesses, browses, or uses our website or purchases our products.
 

1.2. By accessing our website or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any additional guidelines, policies, or rules referenced herein or posted elsewhere on our website.
 

1.3. We reserve the right, at our sole discretion, to modify these Terms at any time. Any modifications will be effective immediately upon posting the updated Terms on our website. Your continued use of our website or services following the posting of revised Terms constitutes your acceptance of such changes.
 

2. Age Restrictions and Capacity
 

2.1. By using our website or placing an order, you represent and warrant that:
 

a)   You are at least 18 years of age; or

b)   If you are between 13 and 17 years of age, you have obtained verifiable parental or legal guardian consent to use our website and         services.
 

2.2. Parental Consent Requirements:
 

a)   Users between 13 and 17 years of age must provide verifiable parental consent before making any purchases.

b)   Parents or legal guardians assuming responsibility for purchases made by minors shall be fully responsible for:

     i)   All financial obligations incurred

    ii)   Supervision of the minor’s use of our services

    iii)  Any legal consequences arising from the minor’s use of our services

3. Product Orders and Pricing

3.1. Order Placement:

a)   All orders are subject to acceptance and availability

b)   We reserve the right to refuse any order at our sole discretion

c)   No order shall be deemed accepted until we confirm acceptance in writing

​

3.2. Pricing and Payment:

a)   All prices are listed in Canadian Dollars (CAD)

b)   Full payment is required at the time of order placement

c)   Accepted payment methods include:

     i)   Credit cards: Visa, MasterCard, American Express, ChineUnion Pay, JCB, Diners, Discovery, Electron, Maestro

    ii)   Digital payment systems: Apple Pay and Google Pay

3.3. Pricing Errors:

a)   Despite our best efforts, products may occasionally be mispriced

b)   We reserve the right to:

     i)   Cancel any orders placed at incorrect prices

    ii)   Contact customers to discuss pricing discrepancies

    iii)  Offer the option to proceed with the order at the correct price

c)   Each pricing error will be evaluated on a case-by-case basis with prompt customer communication

4. Shipping and Delivery

4.1. Shipping Timeframes:

a)   Standard shipping within Canada: 5-7 business days

b)   Business days exclude weekends and national holidays

c)   Shipping times are estimates and not guaranteed

​

4.2. Risk of Loss:

a)    Title and risk of loss for all products shall transfer to you upon delivery confirmation

b)   “Delivery confirmation” means:

      i)    Signature verification where required

      ii)   Successful delivery scan by the carrier

      iii)   Photographic evidence of delivery where applicable

5. Order Cancellation Policy

​

5.1. Cancellation Window:

a)   Orders may be cancelled within 1 day of placement without penalty

b)   Cancellation requests must be submitted in writing to resteasycustom@gmail.com

c)   The timestamp of the email request will determine the cancellation eligibility

5.2. Post-Production Cancellations:

a)   Orders cannot be cancelled once customization or production has begun

b)   The Company shall have sole discretion in determining whether production has commenced

c)    If production has begun, customer shall be liable for:

      i)    All materials costs

      ii)   Labor expenses incurred

      iii)  Overhead costs associated with the order

      iv)  Any non-recoverable expenses

5.3. Rush Orders:

a)   Rush orders are subject to stricter cancellation terms

b)   No cancellations will be accepted for rush orders once production scheduling has occurred

c)   Rush order status shall be clearly communicated at time of order placement

​

6. Returns and Refunds

​

6.1. Defective Items:

a)   Manufacturing defects must be reported within 3 days of delivery

b)   Claims must include:

     i)   Order number

    ii)   Detailed description of the defect

    iii)  Clear photographs documenting the defect

    iv)   Proof of delivery

​

6.2. Refund Processing:

a)   Approved refunds will be processed within 2 business days

b)   Refunds will be issued to the original payment method

c)   Processing time may vary based on payment provider policies

​

6.3. Non-Defective Items:

a)   All sales are final for non-defective items

b)   No returns or exchanges will be accepted for:

     i)   Correctly manufactured items

     ii)   Items with subjective issues

    iii)  Items damaged after delivery

    iv)  Items modified or altered by customer

7. Product Descriptions and Variations

​

7.1. Product Variations:

a)   Slight color variations between displayed and delivered products may occur due to:

     i)    Different monitor display settings

     ii)   Natural variations in materials

     iii)  Manufacturing processes

     iv)  Such variations shall not constitute grounds for returns or refunds

​

7.2. Product Descriptions:

a)   We strive to describe products accurately and comprehensively

c)   Product specifications may change without notice

c)   We reserve the right to:

     i)   Modify product descriptions

     ii)   Discontinue products

     iii)  Limit order quantities

8. Warranty Terms

8.1. Limited Warranty Coverage:

a)   Products are warranted against manufacturing defects only

b)   Warranty period: 3 days from delivery

c)   Warranty covers:

     iii)  Finishing defects

8.2. Warranty Exclusions:

a)   Warranty does not cover:

     i)   Normal wear and tear

     ii)   Misuse or abuse

     iii)  Unauthorized modifications

     iv)  Environmental damage

     v)   Consequential damages

a)   Users are granted a limited, non-exclusive, non-transferable license to:

      ii)   Place orders

      iii)   Use purchased products for personal use

b)   This license does not permit:

      i)    Commercial use

      ii)   Reproduction

      iii)  Distribution

      iv)   Modification of any content

11. Limitation of Liability

11.1. Maximum Liability:

a)    Our liability for any claim arising from these Terms or any product purchase shall not exceed:

       i)   The purchase price of the specific product giving rise to the claim

       ii)  Any mandatory minimum liability required by applicable law

11.2. Exclusions:

a)     We shall not be liable for:

       i)    Indirect, incidental, or consequential damages

       ii)   Lost profits or revenue

       iii)  Business interruption

       iv)  Data loss

       v)  Any damages not reasonably foreseeable

11.3. Force Majeure:

a)    We shall not be liable for any failure or delay caused by circumstances beyond our reasonable control, including:

       i)    Natural disasters

       ii)   Government actions

       iii)   Labor disputes

       iv)   Power failures

       v)    Internet or telecommunications failures

12. Dispute Resolution

12.1. Mandatory Mediation:

a)   Prior to initiating legal proceedings, parties must attempt to resolve disputes through mediation

b)   Mediation shall be conducted by a mutually agreed-upon mediator

c)   Mediation costs shall be shared equally unless otherwise agreed

12.2. Mediation Process:

a)   The party initiating mediation shall provide written notice to the other party

b)   Mediation shall commence within 30 days of such notice

c)   Mediation sessions shall be confidential

d)   Parties shall participate in good faith

12.3. Court Proceedings:

a)   If mediation fails to resolve the dispute within 60 days, either party may initiate court proceedings

b)   Exclusive jurisdiction and venue shall be:

     i)    For domestic disputes: The courts of British Columbia, Canada

     ii)   For international disputes: The federal courts of Canada

     iii)  The prevailing party shall be entitled to reasonable attorney’s fees and costs

13. Notices and Communication

     iii)   One business day after email transmission with confirmation

     iv)    Each party shall notify the other of any change in contact information

14. Severability and Interpretation

14.1. Severability:

a)   If any provision of these Terms is found to be invalid, illegal, or unenforceable:

      i)    The remaining provisions shall continue in full force and effect

      ii)   The invalid provision shall be modified to the minimum extent necessary

      iii)   If modification is not possible, the provision shall be severed

14.2. Interpretation:

a)   Section headings are for convenience only

b)   These Terms shall be interpreted according to their fair meaning

c)    No provision shall be construed against the drafting party

15. Modification and Termination

​

15.1. Modifications:

a)   We reserve the right to modify these Terms at any time

b)   Changes will be effective upon posting to the website

c)   Continued use constitutes acceptance of modifications

d)   Material changes will be communicated via:

      ii)   Website announcement

      iii)   Other reasonable means
